Peak4X B.V. (“Peak4X”, “we”, “us” or “our”) is an executive search and leadership integration firm. We identify, assess and introduce senior executives and other leadership candidates to clients and support successful onboarding and integration.

  • executives, interim managers and other professionals in our network
  • client contacts, prospects, suppliers and business partners

  • other individuals whose personal data is processed in connection with our executive search, assessment, integration and business activities

A client may provide additional information about how it processes candidate data for its own purposes. Where both Peak4X and a client independently determine the purposes and means of processing, each party acts as a separate data controller.

3. Personal data we process

3.1 Candidate and professional data

Depending on the circumstances, we may process the following categories of personal data:

  • identification and contact details, such as name, title, address, telephone number, email address and online profile links
  • professional information, such as curriculum vitae, employment history, education, qualifications, skills, sector experience, language abilities, board roles and professional interests
  • information about current and desired role, remuneration, availability, mobility, location preferences and career objectives
  • notes and assessments from interviews, meetings, reference checks, assessments and communications
  • information relating to suitability for a role, including leadership experience, competencies, motivations and development or integration considerations
  • information supplied by referees, clients, colleagues or other professional contacts
  • publicly available professional information, including information from company websites, professional directories, press publications and professional networking platforms
  • administrative information connected with an assignment, placement, integration programme or contractual relationship
  • any other personal data that you voluntarily provide to us

3.2 Special categories and sensitive information

We do not intentionally seek to collect special categories of personal data, such as information about health, ethnicity, political opinions, religion, trade-union membership, genetic or biometric data, or sexual orientation, unless this is necessary and lawful for a specific purpose. Where we process such data, we will rely on an appropriate legal basis and, where required, an additional condition under applicable data protection law.

Please do not send us sensitive personal information that is not relevant to an executive search or integration process.

3.3 Client, supplier and business contact data

4. How we obtain personal data

We may obtain personal data:

  • directly from you, for example when you contact us, provide a CV, participate in an interview or engage with an integration programme
  • from clients, referees, colleagues, professional contacts and other third parties
  • from publicly accessible sources, including company websites, professional networking platforms, press publications, registers and professional directories
  • through research undertaken by Peak4X or specialist research partners acting on our instructions
  • from our website, email systems, CRM and other business systems
  • from previous professional interactions with you

Where we obtain your personal data from another source, we will provide the information required by applicable law within the relevant period, unless an exception applies.

5. Why we process personal data and our legal bases

We process personal data only where we have a lawful basis. The legal basis depends on the relevant purpose and circumstances.

  • Executive search and candidate identification.To identify, research and approach potential candidates; assess experience and suitability; maintain professional contact; and prepare candidate profiles. Typical legal basis: legitimate interests in delivering executive search services and matching leadership talent with appropriate opportunities; consent where required.
  • Candidate introduction and recruitment processes.To communicate with candidates and clients, arrange interviews, share agreed candidate information, obtain feedback and facilitate negotiations or engagement. Typical legal basis: steps taken at your request before entering into a contract; performance of a contract; legitimate interests; and consent where appropriate.
  • Reference checks, assessments and verification.To conduct agreed references, assessments, background checks or verification relevant to a role. Typical legal basis: legitimate interests, consent and/or compliance with legal obligations, depending on the nature of the check.
  • Leadership integration and onboarding.To plan and deliver agreed integration or onboarding services and communicate with candidates, clients and relevant stakeholders. Typical legal basis: performance of a contract and legitimate interests in supporting a successful placement and integration.
  • Talent and relationship management.To maintain professional relationships, keep relevant records, identify future opportunities and contact you about assignments that may be relevant. Typical legal basis: legitimate interests; consent where required by law or where we expressly ask for it.
  • Client and supplier management.To prepare proposals, manage assignments, contracts, invoicing, payments, supplier relationships and business communications. Typical legal basis: performance of a contract, steps before entering into a contract, legitimate interests and compliance with legal obligations.
  • Website operation and enquiries.To operate and secure our website, respond to enquiries, diagnose technical issues and understand website use. Typical legal basis: legitimate interests; consent for non-essential cookies or similar technologies where required.

7. Sharing personal data

We may share personal data, where necessary and lawful, with:

  • clients and prospective clients in connection with a specific assignment or professional opportunity
  • members of the Peak4X team and authorised consultants or research partners
  • service providers supporting our CRM, IT hosting, communications, document management, website, security, professional advice, finance and administration
  • assessment, reference-checking or verification providers where these services have been agreed
  • professional advisers, insurers, auditors, banks and other advisers
  • public authorities, courts, regulators or law-enforcement bodies where disclosure is legally required or necessary to protect legal rights
  • a purchaser, investor or successor in connection with a proposed or completed merger, acquisition, reorganisation or transfer of all or part of our business

We do not sell personal data. We require service providers processing personal data on our behalf to protect it and to process it only in accordance with our instructions and applicable law.

8. International transfers

Some clients, candidates or service providers may be located outside the European Economic Area (“EEA”), or may process personal data from locations outside the EEA. Where personal data is transferred to a country that has not been recognised as providing an adequate level of data protection, we use appropriate safeguards where required, such as European Commission standard contractual clauses, and assess whether supplementary measures are necessary.

9. Retention of personal data

We retain personal data only for as long as reasonably necessary for the relevant purpose, taking into account the nature of the information, the relationship concerned, legal and contractual requirements, limitation periods and the need to establish or defend legal claims.

  • Candidate and professional records.Generally for the duration of an active assignment or professional relationship and for up to 24 months after the last meaningful contact or completion of the relevant process, unless a longer period is justified, agreed or required by law.
  • Successful placement and integration records.For the duration of the client relationship, the applicable guarantee and integration period, and thereafter for the period reasonably required for contractual, legal, tax, insurance and claims purposes.
  • Client, supplier and contract records.Generally for the duration of the relationship and thereafter in accordance with statutory administration, tax and limitation periods.
  • Unsuccessful enquiries and website communications.For as long as necessary to respond and follow up, and normally no longer than 24 months unless there is an ongoing relationship or legal reason to retain them.
  • Technical and security logs.For a limited period appropriate to website operation, security, troubleshooting and fraud prevention.

The periods above are indicative and must be applied in light of the specific circumstances. We may retain limited information for longer where necessary to record your preferences, demonstrate compliance, resolve disputes or establish, exercise or defend legal claims.

10. Security

We use appropriate technical and organisational measures designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure, access or other misuse. These measures may include access controls, confidentiality obligations, secure systems, backups, monitoring, staff awareness and vendor due diligence.

No system or method of transmission is completely secure. If you believe that personal data has been compromised, please contact us promptly.

11. Your data protection rights

Subject to applicable conditions and exceptions, you may have the right to:

  • request access to your personal data and obtain a copy
  • request correction of inaccurate or incomplete personal data
  • request deletion of personal data
  • request restriction of processing
  • object to processing based on legitimate interests, including profiling based on those interests
  • object at any time to processing for direct marketing purposes
  • receive certain personal data in a structured, commonly used and machine-readable format and transmit it to another controller
  • withdraw consent at any time where processing is based on consent, without affecting the lawfulness of processing before withdrawal
  • lodge a complaint with a competent data protection authority

These rights are not absolute. We may decline or limit a request where permitted by law, for example where disclosure would adversely affect the rights and freedoms of others, legal privilege, confidential business information or the establishment, exercise or defence of legal claims.

12. Automated decision-making

Peak4X does not make decisions producing legal effects or similarly significant effects on individuals solely by automated means. Technology may support research, matching, administration or analysis, but material candidate assessments and recommendations involve human judgement.

13. Cookies and website analytics

Our website may use cookies and similar technologies. Strictly necessary cookies may be used to operate and secure the website. Analytics, preference, advertising or other non-essential cookies will be used only where permitted and, where required, after obtaining consent.

14. Links to other websites

Our website and communications may contain links to third-party websites or platforms. Peak4X is not responsible for the privacy practices of those third parties. We recommend reviewing their privacy notices before providing personal data.

Our services are not directed at children and we do not knowingly collect personal data from persons under 16 through our website. If you believe that a child has provided personal data to us, please contact us so that we can take appropriate action.
